TERMS OF SERVICE

PLEASE READ

• Payment via PayPal only;
• I accept 50% of the payment before I start the sketching phase (I will need the other 50% before I send the final files via email) or 100% up front;
• References: I can work off descriptions and random images, but this will cost extra depending on how much I have to put together myself!
About Commercial commissions:
I accept commercial commissions. The price will depend on the purpose and will be discussed over the client’s preferred way of communication.
COMMERCIAL TOSBy purchasing my services (art), you automatically agree to the following conditions.
• I do not allow my art to be used for AI purposes and alike. Please do not upload it to any AI sites as this could compromise my artwork.
• NFT usage is strictly forbidden.
By commissioning me, you agree that you have read and accepted all the terms described herein.
• I reserve the right to decline any project or client for any reason.
• I reserve the right to refund you the full amount paid (not including the paypal fees) if I no longer wish to work on your project for any reason.
• I reserve the right to publish the artwork on my social medias unless the client otherwise requests. If you wish for your commission to be private, it must be stated during the ordering process. The privacy request entails that I am not allowed to share any WIPs or the finished product on social media.COPYRIGHT
The commissioner can:
• Use the artwork for personal use including but not limited to: avatars, phone or computer wallpapers, personal website/profile displays and printing for personal use.
• Use the artwork to promote themselves (e.g. on stream layouts or posts on social media).
You are NOT allowed to:
• Take credit for the creation of artwork;
• Reproduce the artwork commercially (e.g. selling prints or use it on merch);
• Remove or alter signatures;
Alter artwork without my consent.

• Fill out the Google form here.
• I will then contact you via email/instagram/twitter/reddit where I will confirm your slot.
• Any emails, private messages, and comments that you send must come in the following languages: English or Italian.
• Before payment, you are required to wait for a reply so that we can discuss the details.
• After everything is processed and confirmed, you need to confirm the payment with me and I’ll start your order.
PAYMENT
• Payment through my paypal.me
• I am not responsible for any mistakes that are made on your part over the course of the transaction.
• I will only accept EUR (Euros) via Paypal as payment. You are responsible for making currency conversions.
• Full 100% price upfront / 50% before the sketching phase and 50% before sending the final files.
• Do not send me any kind of payment until I have confirmed I can accept your commission AND have asked for payment.
• Please note that all of my sales are "Digital Artwork" and it is the Artwork’s "Intellectual Property" that is purchased by you, the Client.
• Nothing is ever intended by either me or the Client to be physically shipped to them.
REFUNDS
• I can refund 100% of the payment if I have not started working on the sketch (fees excluded).
• If I cancel a project, I will give a 100% refund (fees excluded).
• If we agree on a payment plan and I start the commission after the first deposit has been done, I will not refund your said deposit if you back out of the Payment Plan.
CHARGEBACK
• You are NOT authorized to issue a chargeback for any reason.
• If for any reason your PayPal account malfunctions or authorizes a refund request without your knowledge, you must contact me as soon as possible in order to resolve the issue.
• You are required to contact me when you need to cancel a commission request.
• Purposefully issuing a chargeback without contacting me to cancel/refund a project will result in immediate blacklisting for you as well as your email address, and anyone sharing your PayPal account, including side accounts.
SCHEDULING / WORK SPEED / DEADLINES
• I will try to respond to your initial order inquiry as soon as possible. Sometimes it might take a couple of days.
• You reserve the right to set a deadline for your commission. This deadline must be disclosed prior to payment.
• I have the right to decline a project if there is too short of a time allowance.
• Art process may take 1-2 weeks or more.
• You reserve the right to be notified of any delays.
PROCESS
• I will send a WIP (‘work in progress’) sketch image after I receive the payment. The responsibility is on you to ensure your order contains the details you want me to follow.
• Revisions can be made during the sketch phase of the commission.
• After we agree on the sketch, only minor adjustments within reason can be made.
• I will update you to ask for feedback.
• When I’m done with the commission, I will ask for the rest of the payment (only if you didn't pay 100% upfront).
• I will send you the final product via email in .png format.
• The commissioner must respect that my artistic style cannot be altered.
• Credit is extremely appreciated if you post or use it on another platform.
• You, the Client, are responsible for saving any information, images, and other digital data I provide. Any file you paid for will be available from me for a finite time only. I take measures to preserve most files for up to 3 months. However, I cannot guarantee against computer failure or accidental deletion or loss.

Commercial Use Terms of Service for Commissioning Artwork

PLEASE READ THIS AFTER ACCEPTING THE GENERAL TOSBY PAYING FOR THE COMMISSION, YOU AUTOMATICALLY AGREE TO THESE TERMS OF SERVICE

Project Delivery Method:
• The project will be delivered to the commissioner’s email address as a .zip / .png file or through a google drive link sent by email.
• Payment is through Paypal. Full payment and payment plans are both available. A paypal link will be sent to your email address, or to the primary contact method.
Usage Rights:
• All commissioned artwork and designs must be appropriately credited to Bandaalarga.
• For a fee or separate agreed upon terms of compensation a commercial use license can be purchased which would allow the commissioner to use the commissioned work for all sorts of money making and advertising activity except for “NFT” or “Non Fungible Token” transactions or advertising “NFTs” or “Non Fungible Tokens” or any other crypto-currency related activities.
• The commissioner agrees to having the artist (Bandaalarga) post the commercial commission on their social media accounts, unless stated otherwise during communication.
Other Prohibited Activities:
• Commissioned artworks may not be used to advertise, encourage, or support hate or discrimination to any groups based on age, race, ethnicity, ability or disability, gender and/or sexual/romantic orientation, appearance, or religion.
• Commissioned artwork may not be heavily edited by anyone except for Bandaalarga unless it is a necessary function of the project. Bandaalarga must be made aware of this before working on the project.
• Artwork by Bandaalarga may never be used for AI technology. It may not be used to train, advertise, endorse, or otherwise benefit AI technology in any capacity.
• Artwork by Bandaalarga may never be used for NFT activities. This includes advertising or endorsing NFTs/ NFT sales as well as using as NFTs.
• Bandaalarga will never resell the commissioner’s commissioned work.
